By downloading, installing, accessing, or using the Sammy mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Sammy ("I," "me," "my," or "Sammy"). Please read them carefully.

You must be at least 17 years of age to use this App.

By using Sammy, you represent and warrant that you are at least 17 years old.

2. Description of Service

Sammy is a content delivery app that offers a mix of entertainment, social commentary, humor, news and other content. The App is currently read-only, meaning you consume content created and curated by Sammy. A share feature allows you to share content with others outside the App.

The App is provided free of charge. I reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice.

3. Content Disclaimer

3.1 Nature of Content

The content delivered through Sammy includes, but is not limited to:

  • Original content created by me
  • Content that may be generated or assisted by artificial intelligence (AI)
  • Content curated and shared from third-party sources (including but not limited to social media platforms, websites, and other online sources)

You acknowledge and understand that:

AI-Generated Content: Some content may be created, in whole or in part, using artificial intelligence tools. AI-generated content may contain inaccuracies, errors, or unintended outputs. I do not guarantee the accuracy, completeness, or reliability of AI-generated content.

Third-Party Content: Content sourced from third parties is provided for entertainment and informational purposes. I do not claim ownership of third-party content, and such content remains the property of its respective owners.

3.2 Controversial and Sensitive Content

IMPORTANT - PLEASE READ CAREFULLY:

Sammy delivers content that reflects opinions, humor, satire, and commentary on various topics. The nature of this content means that some users may find certain posts controversial, offensive, provocative, harsh, insensitive, or disagreeable.

Content may include:

  • Strong opinions and social commentary
  • Satire, sarcasm, and humor that some may find offensive
  • Commentary on current events and social trends
  • Content that challenges conventional viewpoints

By using this App, you acknowledge and accept that:

  1. Content is subjective. What one person finds humorous or insightful, another may find offensive or hurtful. This is inherent to opinion-based and satirical content.
  2. You assume all the risks. You voluntarily choose to consume content on Sammy. Any emotional, psychological, or other impact that the content may have on you is your sole responsibility.
  3. I am not liable for your reaction. I am not responsible for any distress, offense, disagreement, emotional harm, or any other negative experience you may have as a result of viewing content on Sammy.
  4. Content does not constitute advice. Nothing in the App should be construed as professional, legal, financial, medical, psychological or any other form of advice. Any actions you take based on content are at your own risk.
  5. You can stop using the App at any time. If you find the content objectionable, your sole remedy is to discontinue use of the App.

3.3 No Endorsement

The views and opinions expressed in content on Sammy do not necessarily represent my official position on any matter. Sharing or displaying content does not imply endorsement of the views expressed therein.

4. Intellectual Property

4.1 My Content

Original content created by Sammy is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from my original content without my express written permission.

4.2 Third-Party Content

Sammy may display content sourced from third-party platforms and creators. Such content remains the intellectual property of its respective owners. If you are a content owner and believe your content has been used in a way that constitutes copyright infringement, please get in touch with me at [ Email provided upon launch ] with:

  • Identification of the copyrighted work
  • Identification of the allegedly infringing content
  • Your contact information
  • A statement of good faith belief that the use is unauthorized
  • A statement, under penalty of perjury, that you are the owner or authorized to act on behalf of the owner

I will review and respond to valid takedown requests in accordance with applicable law.

4.3 Your Use of Content

You may use the share feature to share content with others for personal, non-commercial purposes only. You may not:

  • Use content for commercial purposes without permission
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Frame or embed content in other websites or applications
  • Use automated systems to access or scrape content

5. User Conduct

By using Sammy, you agree not to:

  • Use the App for any unlawful purpose
  • Attempt to interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App to harass, abuse, or harm others
  • Misrepresent your identity or affiliation
  • Use the share feature to spread content in a manner that violates any law or third-party rights

6. Disclaimer of Warranties

The App and all content are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, I disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the App will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of any content
  • Warranties regarding the results that may be obtained from using the App

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  1. I shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses.
  2. I shall not be liable for any damages arising from: your use of or inability to use the App; any content displayed on the App, including AI-generated or third-party content; any emotional distress, offense, or psychological impact caused by content; unauthorized access to or alteration of your data; or any third-party conduct or content.
  3. My total liability for any claims arising from or related to these Terms or your use of the App shall not exceed the amount you paid to use the App (which is zero, as the App is free).
  4. Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.

8. Indemnification

You agree to indemnify, defend, and hold harmless Sammy, and any affiliates, officers, agents, or partners, from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of any third party
  • Any content you share from the App

9. Dispute Resolution and Arbitration

9.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact me at [ Email provided upon launch ] and attempt to resolve the dispute informally for at least 30 days.

9.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY - IT AFFECTS YOUR LEGAL RIGHTS.

If I cannot resolve a dispute informally, you and I agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively through binding arbitration, rather than in court, except that either party may seek injunctive or equitable relief in court for intellectual property disputes.

Arbitration Procedures:

  • Arbitration shall be conducted in Dubai, United Arab Emirates, in accordance with the rules of the Dubai International Arbitration Centre (DIAC), or another mutually agreed arbitration body.
  • The arbitration shall be conducted in English.
  • The arbitrator's decision shall be final and binding.
  • Judgment on the arbitration award may be entered in any court of competent jurisdiction.

9.3 Class Action Waiver

You and I agree that each party may bring disputes against the other only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

9.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to [ Email provided upon launch ] within 30 days of first using the App. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles. Any disputes not subject to arbitration shall be resolved exclusively in the courts of Dubai, United Arab Emirates.

11. Changes to These Terms

I may update these Terms from time to time. When I make changes:

  • I will update the "Last Updated" date at the top
  • For material changes, I may provide additional notice through the App
  • Your continued use of the App after changes become effective constitutes acceptance of the revised Terms

If you do not agree to the revised Terms, you must stop using the App.

12. Termination

I reserve the right to terminate or suspend your access to the App at any time, for any reason, without notice. Upon termination, your right to use the App ceases immediately.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property provisions, disclaimers, limitations of liability, indemnification, and dispute resolution.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with my Privacy Policy, constitute the entire agreement between you and I regarding your use of the App and supersede any prior agreements.
